1. ESTIMATES AND ORDERS
Estimates issued by Darmes are valid for a period of 30 days. Any modification requested by the client after the estimate has been issued (product type, finishes, quantities, deadlines, or delivery address) may lead to a revision of prices at the discretion of Darmes.
2. PAYMENT TERMS
A payment of 50% of the total invoice amount is required to launch production. Full payment of the invoice is required before any shipment, delivery, or installation. We accept bank transfers and credit cards in the currency indicated on the invoice.
3. ACCEPTANCE OF CONDITIONS
Payment, even partial, of an order by the client implies their complete acceptance of these general terms and conditions of sale and constitutes a final confirmation of their order.
4. INTERNATIONAL DELIVERY AND RESPONSIBILITY
- Darmes Transport Service (DAP Incoterms): If you choose our transport service, the costs are added to your invoice. We assume responsibility for packaging, transport, and insurance up to the delivery address. Depending on the country, customs duties and taxes may be claimed by the carrier (DAP), unless there is a specific agreement for a DDP service.
- Client Transport (EXW Incoterms): If you pick up your order or use your own carrier, the merchandise is no longer our responsibility once it leaves our premises in Saint-Adolphe-d’Howard. The client must assume transport, insurance, and customs clearance.
5. CANCELLATION AND RETURNS
- Catalogue Products: Any cancellation or return incurs a fee of 25% of the retail price, in addition to shipping and return costs.
- Special / Custom Projects: For custom-made light fixtures, orders are non-cancellable.
- Deadline and Conditions: Products must be returned unopened, at the client’s expense, and must reach us in perfect condition. Any request for a refund or return must be made within 30 days of receiving the merchandise.
6. DAMAGE AND INSPECTION
If the packaging appears damaged upon receipt, please accept the delivery but take photos of the package before opening. You have 7 days from the delivery date to inspect the merchandise and report any damage or missing items to us.
7. WARRANTY AND ARTISANAL CHARACTERISTICS
All our products are guaranteed for a period of one year from the date of delivery for normal use.
Artisanal Variations (Glass and Porcelain): Darmes creates original, handmade products. Due to this process, slight color variations are natural. These characteristics are part of the uniqueness of each piece and cannot be considered defects.
8. DATA PROTECTION (LAW 25)
Darmes is committed to protecting the confidentiality of its clients’ personal data in accordance with Quebec’s Law 25. The information collected is used solely for processing orders and improving our services.
9. APPLICABLE LAW AND JURISDICTION
These conditions are governed by the laws of the province of Quebec and the federal laws of Canada. Any dispute will be submitted to the exclusive jurisdiction of the courts of the judicial district of Terrebonne (Quebec, Canada). Darmes’ head office is located at 1825 Chemin du Village in Saint-Adolphe-d’Howard, Quebec, Canada.
