Terms & Conditions

Designer and manufacturer of premium lighting products, d’Armes creates original and customisable lamps, made to order in Montreal.

Definitions

In order to lighten the following text, the term “you” will sometimes be used to designate the client and the term “we” will sometimes be used to designate d’Armes.

Estimates

Estimates are based on information provided by the customer to d’Armes on the date of shipment. They are valid for 30 days. Any modification requested by the customer at a later date may lead to a revision of the rates at the discretion of d’Armes. Notably, but not exclusively: the type of lighting product, dimensions and finishes, quantities ordered, production times, address and type of delivery.

Order

When the customer has indicated their intention to buy from d’Armes and communicated all or part of the information necessary for the production, we will send them an invoice. This invoice is based on the information we have at the time of the order. Any modification requested by the customer at a later date may lead to a revision of the rates at the discretion of d’Armes. Notably, but not exclusively: the type of lighting product, dimensions and finishes, quantities ordered, production times, address and type of delivery.

Payment Terms

Payment of 50% or more of the total amount of the invoice is required to start production. Payment in full of the invoice is required before any handover, shipping, delivery or installation of the products purchased.

Payment Methods

We accept payments by checks, bank transfers, and Visa and Mastercard credit cards in the currency indicated on the invoice.

Confirmation of the order and acceptance of the general terms and conditions of sale

The payment, even a partial payment, of an order by the customer implies their complete acceptance of the present general terms and conditions of sale and constitutes a confirmation of their order.

Delivery

We advise you to choose our transport service (usually UPS). In this case, shipping charges will be added to your invoice and the applicable delivery terms (Incoterms) are DAP. We take care of packing, transport, insurance and customs clearance to the delivery address indicated on the invoice.

Depending on the country of delivery, customs duties, sales tax and collection charges may be requested by the carrier at the time of delivery. On request we can provide you with an indicative estimate of these costs. Contact us if you wish to be assured of having nothing to pay at the time of delivery (Incoterms: DDP).

In the event that you are unable to accept your order and/or fail to respond to UPS’s requests, the cost of returning your shipment and re-dispatch will be at your expense.

In the event that the customer comes to pick up their order themselves or has their order picked up by the carrier of their choice, the applicable delivery terms (Incoterms) are EXW. In this case we only take responsibility for the packaging of the order. The merchandise is no longer under our responsibility once it has left our premises. You must assume the transportation, insurance and clearance of the goods.

Cancellation and returns

Any order cancellation or catalogue product return entails costs of an amount equal to 25% of the retail price plus any cost related to shipping and return. In the case of special projects or tailor-made lamps the costs are 50% of the order amount.

Lighting products must be returned unopened at the customer’s expense and reach us in perfect condition before we proceed to a refund.

Damages

In case the packaging of your order seems to have been damaged during transport, please accept the delivery regardless. Our lighting products are packed with care and the outer packaging may have been damaged without your order being damaged. Before opening the packages, take photographs of the package.

Our lighting products have been inspected to ensure that they are functioning perfectly and we have verified that there were no missing items when sending your order. You have 7 days from the delivery date indicated by the carrier to ensure the good condition of the goods received and to report any damage or missing packages.

Warranty

All our products are guaranteed for a period of one year from the date of delivery of the order. This warranty covers proper operation for normal use and excludes damage resulting from accident, misuse, or neglect. All complaints must be reported to us by e-mail with photographs proving the defect. D’Armes will repair or replace the defective product at his own discretion.

Characteristics of RA Models

The RA Suspension and RA Murale models have a cold cathode neon as the source of light, manufactured by hand in Montreal. The following characteristics are related to this technology and cannot be considered a defect:

  • Additional wiring is required to make the lamp brightness variable.
  • The transformer can emit a slight noise when the light is varied at a low intensity.
  • The appearance and dimensions of the neon tube may vary slightly.
  • A mixture of rare minerals is present in the glass tube to give the light its radiance and warmth. Very small stains may appear over time.
  • The neon sign tubes used are designed to last for years, their lifetime can be reduced in case of impacts that create micro-cracks. D’Armes offers tube replacements, additional charges apply after the warranty period.
